Will Apple Suffer a Sales Ban?

Updated December 22, 2011

A press release posted on Yahoo! News reports that Samsung would file court injunctions in France and Italy to implement a sales ban of Apple’s newest smartphone- the iPhone 4S- another blow that would intensify the long-standing feud between the two tech giants.

The latest plans of Samsung reveal an official filing of preliminary injunctions in Paris and Milan asking to block the sales of the iPhone 4S. This is connected to the patent infringement case of Samsung against the Apple’s own version of wireless communications technology.

Samsung said in its statement:  "Apple has continued to flagrantly violate our intellectual property rights and free ride on our technology, and we will steadfastly protect our intellectual property."

The South Korean-based company keeps mum about the exact date when the French and Italian filings would take place, but asserts that similar actions will be implemented after there is a proper analysis of the situation.

As a matter of fact, the announcement of legal action against Apple took place the day after the new iPhone 4S was unveiled in the United States.

Remember that the two smartphone companies have been exchanging fiery responses since April when the creator of iPhones and iPads filed a lawsuit against Samsung’s Galaxy line of smartphones- saying that Samsung copied the elements featured on their own products. Samsung reciprocated by filing a counter suit of Apple’s alleged violations of Samsung’s patents covering wireless communications.

The reason why Samsung was vehement about its claims was that Apple’s infringes “are essential to the reliable functioning of telecom networks and devices” and that Samsung perceived the violation as “too severe and (the) iPhone 4S should be barred from sales”.

Earlier than that, Apple won the sales injunction against Samsung’s products in Germany and Netherlands, and is advancing one in Australia. In response, Samsung has asked the court to impede the sales of Apple products like iPads and iPhones in the Netherlands.

As we see, there is more to come of these two tech giants not only vying for the attention of the mass media but also competing for the favors of the courthouses.

But whatever happens to the cases, one thing is for sure! We are only here to enjoy the fruits of technology! As consumers, our sole concern is to ensure that what we get from these companies are products of high quality. What with those outrageous price tags!

And now that the iPhone 4S is out, why don’t you grab it and try it? If you can’t because you fear the ghost of your empty pocket, why don’t you just sell your old iPhone so that you’ll get some cash for the newest iPhone purchase?
